At Aisha Francis Studios, we are committed to providing a welcoming and professional space where participants can grow, learn, and dance. These Terms and Conditions are designed to ensure a positive experience for everyone while protecting the integrity of our offerings.

For the purposes of these Terms and Conditions, "Aisha Francis Studios" refers to Aisha Francis, her business entities, and related products and services, including but not limited to classes, courses, programs, workshops, mentorships, events, digital products, merchandise, and any affiliated platforms, apps, or rented venues. 

By completing your purchase of any offering from Aisha Francis Studios and checking the box to indicate your agreement, you confirm that you have read, understood, and agreed to these Terms and Conditions, as well as the Privacy Policy. If you do not agree, you must not complete your purchase.

1. General Terms

By participating in any services provided by Aisha Francis Studios, you agree to:

• Respect the rules and guidelines set forth in these Terms and Conditions.
• Conduct yourself respectfully toward instructors, staff, and fellow participants.
• Focus on the purpose of your enrollment (e.g., dance training) and refrain from promoting your own business during class instruction, group chats, or official studio activities until the session concludes and assigned tasks (e.g., homework) are completed.

Aisha Francis Studios is not liable for cancellations, delays, or non-performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, pandemics, or technical disruptions.

2. Enrollment, Payment, and Deposits

• All Sales Final: To maintain fairness and integrity, refunds are not available under any circumstances.
• Pricing: The price covers all sessions as a package. Individual sessions cannot be purchased, and fees will not be prorated under any circumstances, including for missed sessions or cancellations.
• Location Changes: Locations are subject to change. Updates will be communicated via email to the address provided at registration. Participants are responsible for regularly checking their email, including spam or junk folders, for notifications.
• Enrollment Confirmation: Participation is confirmed only upon completion of full payment through official channels at www.aishafrancis.com.
• Confirmation Email: Participants will receive a registration confirmation email with class details after payment. If you do not receive the email, contact support@aishafrancis.com promptly.
• Payment Plans:
  • A non-refundable deposit of 50% of the total fee is required to secure a reservation.
  • The balance must be paid in full at least two weeks prior to the start date. Failure to complete payment by the deadline will result in forfeiture of the reservation, with no refunds of deposits.
• Attendance Responsibility: Full attendance at all sessions is strongly recommended for optimal results. Missed sessions cannot be made up, transferred, or assigned to another participant. Full payment is required regardless of attendance, and prorated participation is not allowed.
• Non-Transferable: Session fees cover your enrollment only and cannot be transferred to other participants or future session. Missed sessions are not eligible for transfers or credits.
• Digital Products: Digital products are for individual use only. Sharing, distributing, or reproducing these products, whether free or for commercial purposes, is strictly prohibited without explicit written consent.

3. Travel and Accommodation Policies

Participants are responsible for managing and financing their travel, transportation, and accommodation arrangements related to offerings by Aisha Francis Studios. We strongly recommend that participants purchase refundable tickets, accommodations, and travel insurance to safeguard against unforeseen changes.

• Liability Disclaimer: Aisha Francis Studios is not liable for any costs, fees, or losses associated with travel, transportation, or lodging. This includes, but is not limited to, expenses incurred due to changes to the location, date, or time of offerings, or their cancellation. 
• Recommendation for Refundable Arrangements: We strongly recommend that participants purchase refundable tickets, accommodations, or travel insurance, as all aspects of our offerings—including but not limited to locations, dates, and times—are subject to change. 
• Cancellation by Aisha Francis Studios: In the rare event that an offering is canceled by Aisha Francis Studios, participants will receive a refund of the enrollment fee. However, Aisha Francis Studios will not reimburse any costs or expenses incurred by participants, including but not limited to travel, lodging, meals, transportation, parking, visas, or any other incidental or consequential expenses related to attending our offerings. 
• Force Majeure Clause: As stated in Section 1, Aisha Francis Studios is not responsible for cancellations, delays, or changes resulting from circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, or other unforeseeable events. By enrolling, participants acknowledge and accept full responsibility for their travel and lodging arrangements and agree to the terms outlined above.

4. Membership Policies

Memberships at Aisha Francis Studios are offered exclusively to a select group of participants by invitation only. These programs are designed for dancers who demonstrate a commitment to their growth, uphold respect for the studio, and share a passion for its values. By enrolling in any membership, participants agree to the following terms:

• Eligibility and Exclusivity:
• Memberships are extended only by invitation to individuals who consistently embody the studio’s values, including active participation, dedication to growth, and respect for teachings and peers.
• Aisha Francis Studios reserves the right to revoke or deny membership for conduct that violates these terms or conflicts with the integrity of the studio.
• Intellectual Property: Members must adhere to the Intellectual Property policies outlined in Section 10. Misuse of choreography, teaching techniques, or footage—including teaching or distributing learned material without permission—will result in immediate removal from the program and future ineligibility.
• Benefits and Structure: Memberships provide access to structured sessions, training opportunities, and other benefits as detailed in the specific program description.
• Rates and Active Status:
• Membership rates are offered at a discounted rate for active members. Pausing or discontinuing membership will require re-enrollment at the current standard rate.
• Membership fees must be paid in full before the membership period begins.
• Add-On Options: Optional add-ons, such as private coaching or filmed sessions, are available and subject to scheduling and availability.
• Payment and Refunds: Membership fees and add-ons are non-refundable, consistent with the No Refund Policy in Section 7. Missed sessions cannot be credited, transferred, or rescheduled.
• Program Adjustments and Cancellations: Adjustments or cancellations initiated by Aisha Francis Studios will follow the policies outlined in Section 3. Refunds may be issued for canceled portions of the program as deemed appropriate.

By enrolling, members affirm their understanding of these policies, their commitment to the studio’s mission, and their agreement to uphold the integrity of the membership program.

5. Communication

• Primary Contact: The official form of communication is email: support@aishafrancis.com.
• Social Media: Direct messages (DMs) sent to personal or studio accounts may not be answered. Urgent or essential matters must be communicated via email.

• SMS Messaging Terms
  By providing your phone number and opting in to SMS communications, you agree to receive transactional and promotional text messages from Aisha Francis Studios. This may include, but is not limited to, reminders about classes, cart abandonment messages, updates about your enrollment, or promotional offers.

  • Opt-In Consent: You will only receive SMS messages if you have explicitly opted in by providing your phone number and agreeing to receive such messages.

  • Opt-Out Option: You may opt-out of SMS messaging at any time by replying "STOP" to any SMS message or contacting support@aishafrancis.com.

  • Message and Data Rates: Standard message and data rates may apply based on your mobile carrier's plan. Participants are responsible for any fees charged by their mobile provider.

Accuracy of Contact Information: It is your responsibility to provide accurate contact information. Aisha Francis Studios is not responsible for communication delays or issues caused by incorrect or outdated phone numbers, emails or any other forms of contact.

6. Digital Product Delivery

• Digital products will be delivered to the email address provided at the time of purchase.
• If you do not receive your product, contact support@aishafrancis.com for assistance.
• Aisha Francis Studios is not responsible for delays caused by incorrect email addresses or technical issues on the participant’s end.

7. No Refund Policy

All sales are final. Refunds are not available under any circumstances, including but not limited to:

• Changes of mind.
• Missed sessions.
• Scheduling conflicts.
• Changes to class location or venue.
• Incorrect self-placement into a level.

If Aisha Francis Studios cancels an offering, participants will be notified via email and provided with a refund or the option to attend a rescheduled session. If a rescheduled session is offered, participants must confirm attendance within the specified time. Failure to confirm will result in forfeiture without refund.

8. Schedule Adjustments and Changes

Aisha Francis Studios reserves the right to adjust class schedules, including changes to the date, time, and/or location of any offering, due to unforeseen circumstances. These may include, but are not limited to, natural disasters, extreme weather conditions, venue conflicts, health-related emergencies, or circumstances beyond our control that require scheduling adjustments.

• In such cases, we will communicate any changes as soon as possible via the contact methods provided at registration, which may include email, chat groups, or other studio communication channels. Participants are responsible for checking these sources regularly for updates.
• If a session must be rescheduled, participants will be notified of the new date and time. When possible, a digital alternative may be offered. While we make every effort to accommodate everyone, we cannot guarantee that the new schedule or format will work for all participants. In such cases, our No Refund Policy remains in effect, and no refunds, credits, or transfers will be issued due to scheduling conflicts arising from rescheduled or adjusted sessions.
• In the rare event that Aisha Francis Studios cancels an offering entirely, participants will be given the option of a refund or transfer to a future session.

By enrolling in any offering, participants acknowledge and accept the possibility of schedule adjustments and agree to abide by the policies outlined above.

9. Chargebacks and Disputes

• By completing your purchase, you agree to resolve disputes directly with support@aishafrancis.com before initiating a chargeback or payment dispute.
• Chargebacks initiated without prior contact violate these Terms and Conditions and may result in legal action.
• The No Refund Policy explicitly applies to all transactions. Chargebacks made in contradiction to this policy will be challenged.

10. Code of Conduct

Participants are expected to uphold the following standards:

• Attire and Hygiene:

  • Wear appropriate clothing, ensuring coverage of sensitive areas.
  • Avoid jewelry that may cause accidents or injuries.
  • Refrain from applying oils or lotions before class to maintain safety.
  • Maintain good personal hygiene, including deodorant use.

• Equipment for Heels Offerings:

  • Wear sturdy, well-fitted heels designed for dance.
  • Inspect footwear for damage before use. Participants are solely responsible for ensuring their heels are safe and suitable.

• Theft: Participants are responsible for safeguarding their belongings. Theft will result in removal from the session without a refund and a ban from future offerings.

• Respectful Behavior: Participants must respect instructors, staff, and peers. Disruptive or inappropriate behavior may result in warnings or immediate removal without a refund, depending on severity, at the sole discretion of Aisha Francis Studios.

11. Intellectual Property

All choreography, teaching methods, training techniques, and materials presented in any Aisha Francis Studios offering are the intellectual property of Aisha Francis Studios and may not be recorded, copied, taught, reproduced, or distributed in any form without explicit written consent.

• Participants are strictly prohibited from:

• • Teaching, selling, or incorporating Aisha Francis Studios' choreography, techniques, or training methods into their own classes, programs, or workshops.
  • Misrepresenting Aisha Francis' techniques as their own.
  • Recording, copying, or distributing any content learned in class, whether for personal, promotional, or commercial use, without written approval.

     

• Sharing Aisha Francis Studios content is allowed only under these conditions:

  • Content may not be used to promote their own classes, choreography, or training programs.
  • Proper credit must be given to Aisha Francis Studios and associated creators by tagging official accounts and clearly attributing the work.
  • Any modifications, edits, or alterations to the original content that misrepresent its origin are strictly prohibited.
  • Full-length routines, breakdowns, or instructional content may not be posted without explicit written permission.

Failure to comply with these conditions may result in removal from offerings, a ban on future participation, and legal action for intellectual property infringement.

Aisha Francis Studios actively enforces its intellectual property rights. Any unauthorized use, teaching, or distribution of its techniques, choreography, or training methods will result in:

• Immediate and permanent removal from all Aisha Francis Studios offerings.
• A ban from future participation.
• Legal action to protect the studio’s intellectual property.

By enrolling in any offering, participants acknowledge that Aisha Francis Studios’ choreography, training methods, and teaching techniques are protected intellectual property and agree to comply with these terms.

12. Liability and Waivers

Participation is voluntary, and participants assume all associated risks. By completing a purchase or registering, you confirm your understanding and agreement to the following:

• Assumption of Risk: Dance activities carry inherent risks. Participants are responsible for acting within their limits. Pregnant participants assume all risks at their discretion.
• Waiver of Claims: You release and hold harmless Aisha Francis Studios and its affiliates from any claims or damages arising from participation.

13. Consent to Filming

By registering, you consent to being filmed or photographed for Aisha Francis Studios' promotional purposes without compensation. If you have concerns, notify support@aishafrancis.com before the offering begins.

14. Governing Law and Dispute Resolution

These Terms and Conditions are governed by California law. Disputes will first be resolved through mediation in Los Angeles, followed by binding arbitration if necessary.

15. Updates to Terms

These Terms and Conditions are effective as of February 26, 2025, and may be updated periodically. The latest version will always be available on our website.

By completing a purchase, you agree to the Terms and Conditions in effect at the time of purchase. By continuing to participate in offerings after updates, you agree to the revised Terms and Conditions.
